Minutes for HB2503 - Committee on Transportation

Short Title

Requiring applicants using a bill of sale for an antique vehicle certificate of title application to be a licensed vehicle dealer unless the applicant provides proof of insurance and applies for vehicle registration and authorizing county sheriffs to perform antique vehicle VIN inspections.

Staff briefed the Committee on the contents of this bill and answered questions.(Attachment 8)

Chairman Proehl recognized Chad Ehrlich. (Attachment 9) According to Mr. Ehrlich current laws in Kansas allow for an antique vehicle to be titled by using a bill of sale to show transfer of ownership and a VIN inspection to confirm the vehicle has not been stolen. He said the required VIN inspection must be completed by the Kansas Highway Patrol.  This bill would allow the local county sheriffs to perform VIN inspections on antique vehicles.  Also, this bill would require anyone applying for an antique vehicle certificate of title using a bill of sale as an ownership document to be a licensed vehicle dealer.

The Chairman recognized Captain Craig Phillips as an opponent to HB2503. (Attachment 10)  According to Captain Phillips it is important that antique VIN inspections on a bill of sale remain the responsibility of the KHP or its designees.  He said antique inspections particularly those on a bill of sale, usually require more scrutiny, as identifying numbers are harder to locate and confirming the identity of the vehicle minus a title requires a trained inspector. He said inspections performed by designees are only done by trained personnel, on a form purchased from KHP.  He stood for questions.

There were no other proponents, opponents or neutrals so the Chairman closed the hearing on HB2503.
